TERMS OF SERVICE

Welcome to SwingX! These Terms of Service ("Terms") govern your access to and use of the SwingX mobile application, website, and services (collectively, the "App"). By creating an account or using SwingX, you agree to be legally bound by these Terms. If you do not agree, you may not use the App.
ACCEPTANCE OF TERMS
These Terms constitute a legally binding agreement between you and SwingX. Your continued use of the App following any updates means you accept the revised Terms.
ELIGIBILITY
You must be at least 18 years old to use SwingX.
By using the App, you confirm that:
You are legally allowed to use adult-oriented social platforms in your jurisdiction;
You have not been convicted of any violent or sexual offense;
You are not a registered sex offender.
ACCOUNT TYPES
SwingX allows:
Single Accounts: Individual user profiles
Couple Accounts: Two users sharing a single profile with mutual visibility of all activities including messages, posts, and interactions.
Users may convert a Single Account into a Couple Account via mutual consent.
COUPLE ACCOUNT DYNAMICS
Couple Accounts grant both users full, mutual access to all activity, messages, and settings.
If one member exits the Couple Account:
All media, profile elements, and posts related to that user are permanently deleted (hard delete).
Shared chat remains accessible but is labeled with "User Left".
No backups of deleted user content are retained.
Both members of a Couple Account have equal and full access to all interactions, content, messages, and matches.
When one member exits:
That user's data (photos, posts, bio) is permanently and irreversibly deleted.
Shared messages are retained and marked with "User Left".
The remaining member retains full access to the account.
SwingX does not mediate disputes between partners. Users are solely responsible for managing their Couple Account dynamics.
USER RESPONSIBILITIES
You agree to:
Use SwingX only for lawful, consensual, and respectful interactions;
Not post or share illegal, abusive, harassing, or non-consensual content;
Not impersonate others or misrepresent your identity;
Respect the boundaries, identities, and consent of all users.
CONTENT AND INTELLECTUAL PROPERTY
You retain ownership of your content but grant SwingX a global, royalty-free license to host, display, and use it within the App.
You may not copy, reverse engineer, or commercially exploit any aspect of SwingX.
FEED AND PUBLIC CONTENT
The Fun Zone feed allows you to share content with the community.
All content in the feed must adhere to our Community Guidelines.
SwingX reserves the right to remove any post or comment at its sole discretion.
SUBSCRIPTIONS AND PAID FEATURES
Some features are available via paid subscription.
Subscriptions auto-renew unless canceled at least 24 hours prior to renewal.
Payments are processed via third-party platforms (Apple/Google).
No refunds are issued for billing cycles that have already begun.
DISCLAIMERS AND LIMITATION OF LIABILITY
SwingX provides the App "as-is" without warranties of any kind.
We are not liable for any harm (emotional, physical, financial) resulting from interactions, matches, or offline meetings.
Our liability is limited to the amount you paid to us in the previous 12 months.
MODERATION AND ENFORCEMENT
We use human to moderate accounts, messages, and posts.
Accounts may be suspended or terminated for violations of these Terms.
You may contact support to appeal moderation decisions, but reinstatement is not guaranteed.
ACCOUNT TERMINATION
SwingX reserves the right to:
Suspend or terminate accounts that violate our Terms or policies;
Retain or delete data as outlined in our Privacy Policy;
Remove access to features or content without notice.
THIRD-PARTY SERVICES AND LINKS
SwingX may include links to third-party websites or services.
We are not responsible for their content, security, or privacy practices.
INDEMNIFICATION
You agree to indemnify and hold harmless SwingX and its affiliates from any claims, damages, or liabilities arising out of:
Your use or misuse of the App;
Content you post or share;
Violation of these Terms or any applicable law.
JURISDICTION AND GOVERNING LAW
These Terms are governed by the laws of Portugal. You agree to submit to the exclusive jurisdiction of the courts in that location.
CHANGES TO TERMS
We may update these Terms periodically. Continued use after such changes constitutes acceptance of the new Terms.
